These terms and conditions outline the rules and regulations for the use of thoughtstack's website and service, located at www.thoughtstack.co.

By accessing this website and using the Service, You accept these terms and conditions in full. Do not continue to use thoughtstack if You do not agree to all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and all Agreements: "Client", "You" and "Your" refers to you, the person using this Service and agreeing to the Company's terms and conditions. "The Company", "We", "Our" and "Us" refers to thoughtstack. "Party", "Parties" refers to both the Client and the Company. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client, in accordance with and subject to, prevailing law of India.

Your Account

When You create an account with Us, You must provide information that is accurate and complete. You are responsible for safeguarding the credentials that You use to access the Service and for any activities or actions under Your account.

You must not share Your account credentials with any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

Service Description

thoughtstack is a content creation platform that helps You capture ideas, research topics, and generate LinkedIn posts using artificial intelligence. The Service includes:

  • Idea capture and organization (Backyard)
  • Idea discovery and research tools
  • AI-powered post generation and refinement
  • LinkedIn integration for publishing posts on Your behalf (when authorized)
  • Email-based idea capture via personalized email addresses

Content Ownership and License

Your Content

You retain full ownership of all content You create, input, or generate through the Service. This includes Your ideas, notes, research highlights, and posts generated by the AI based on Your input.

You are free to use, publish, redistribute, and modify Your generated posts in any way You see fit, including publishing them on LinkedIn or any other platform.

By using the Service, You grant thoughtstack a limited, non-exclusive license to store, process, and transmit Your content solely for the purpose of providing the Service to You. We do not claim any ownership rights over Your content.

Our Content

The Service, its original content (excluding Your content), features, and functionality are and will remain the exclusive property of thoughtstack. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of thoughtstack.

AI-Generated Content

The Service uses artificial intelligence to generate content based on Your input. You acknowledge and agree that:

  • AI-generated content may not always be accurate, original, or suitable for Your intended purpose. You are responsible for reviewing and editing generated content before publishing.
  • thoughtstack does not guarantee that AI-generated content will be free from errors, biases, or factual inaccuracies.
  • You are solely responsible for any content You choose to publish on LinkedIn or any other platform, whether generated by the AI or written by You.
  • We do not use Your content or generated outputs to train AI models.

LinkedIn Integration

The Service allows You to connect Your LinkedIn account and publish posts directly to LinkedIn. By using this feature, You acknowledge and agree that:

  • You authorize thoughtstack to post content to LinkedIn on Your behalf only when You explicitly approve each post.
  • You are responsible for ensuring that any content posted to LinkedIn complies with LinkedIn's terms of service and community guidelines.
  • thoughtstack is not responsible for any consequences arising from content You publish to LinkedIn through the Service, including but not limited to account restrictions, content removal, or reputational impact.
  • You can revoke LinkedIn access at any time from Your Profile settings or directly from LinkedIn's authorized applications settings.

Subscription and Billing

Some features of the Service are available on a subscription basis. By subscribing to a plan, You agree that:

  • Your subscription will automatically renew at the end of each billing period unless You cancel before the renewal date.
  • Post generation limits are based on Your subscription plan and reset at the beginning of each billing cycle.
  • We reserve the right to change subscription pricing with reasonable notice. Price changes will take effect at the start of Your next billing cycle.
  • Refunds are handled on a case-by-case basis. Contact Us if You believe You are entitled to a refund.

Acceptable Use

You agree not to use the Service to:

  • Generate or publish content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or misrepresent Your affiliation with a person or entity.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
  • Use the Service in any manner that could disable, overburden, or impair the Service, or interfere with any other party's use of the Service.
  • Use automated means (bots, scrapers) to access the Service beyond normal usage patterns.

Termination

We may terminate or suspend Your account immediately, without prior notice or liability, for any reason, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your account, You may contact Us to request account deletion.

Upon account deletion, all Your data including ideas, posts, and research will be permanently removed within 30 days, except where We are required by law to retain certain information.

Cookies

We employ the use of cookies. By accessing thoughtstack, You agree to the use of cookies in agreement with thoughtstack's Privacy Policy.

Cookies are used by our website to enable authentication functionality and to remember Your preferences (such as theme settings). We do not use cookies for advertising or third-party tracking.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall thoughtstack, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any content generated by the AI, including errors, inaccuracies, or content that causes harm when published.
  • Any content posted to LinkedIn or other platforms through the Service.
  • Unauthorized access, use, or alteration of Your transmissions or content.
  • Any interruption or cessation of transmission to or from the Service.

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. thoughtstack makes no warranties, expressed or implied, and hereby disclaims all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

thoughtstack does not warrant that the Service will be uninterrupted, timely, secure, or error-free. thoughtstack does not warrant that the results obtained from the use of the Service, including AI-generated content, will be accurate or reliable.

Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, We will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, please stop using the Service.
